The following terms and conditions of sale shall be deemed to be incorporated into and form a part of any contract between Devon Lifestyle Ltd and the Customer whose name and details appear above for the supply of goods, to the exclusion of any terms or conditions set out in the order.
1. PAYMENT: Payment is to be made in full at time purchase (unless otherwise agreed by Devon Lifestyle Ltd). Payment will only be made by the methods agreed by Devon Lifestyle Ltd. The Customer will pay goods and services tax (currently 15%) on all invoices payable in respect of the supply of goods.

2. PRICE: Shall be the price payable for the goods as quoted in the Devon Lifestyle Ltd Web Site. Prices are not binding on Devon Lifestyle Ltd and are subject to change at any time. All prices are exclusive of Goods and Services Tax unless otherwise stated. All prices are in New Zealand dollars.
3. ORDERS: All web site orders for goods shall be deemed to be an offer to purchase the items specified in such order which Devon Lifestyle Ltd may, in its absolute discretion, accept by issuing an invoice in respect of such goods. Devon Lifestyle Ltd may at its discretion accept an order either as regards all the goods listed in the order or any one or more of them. Supply of any goods by Devon Lifestyle Ltd shall constitute acceptance of the order only as regards the goods in respect of which an invoice is issued.
4. VARIATION OF QUANTITIES: Devon Lifestyle Ltd reserves the right to make minor adjustments to order quantities to conform with standard packaging protocol.
5. TRANSFER OF OWNERSHIP & RISK: The ownership and risk of the goods transfer to the customer as soon as the title is passed, regardless of whether the goods have been delivered or not. The completion of the delivery is marked when Devon Lifestyle Ltd hands over the goods for delivery to the customer or to a common carrier or another custodian for the purpose of delivery to the customer. Any delivery timeline stated by Devon Lifestyle Ltd is a mere estimation and the company will make reasonable efforts to meet any requested delivery date; however, it does not guarantee that such date will be met. Devon Lifestyle Ltd shall not be held accountable for any loss or damage resulting directly or indirectly due to a failure to deliver by a specific date.
6. RETURNS & REFUND POLICY: If Devon Lifestyle Ltd delivers any faulty goods which it acknowledges as defective, the company will accept the return of such goods and, at its discretion, replace, repair, or issue a full or partial credit for the price paid by the Customer to Devon Lifestyle Ltd for those goods. This is subject to the condition that Devon Lifestyle Ltd has approved the return, the goods are returned at the Customer’s expense within ten business days of delivery (unless otherwise agreed by Devon Lifestyle Ltd), and a copy of the delivery receipt or invoice accompanies the returned goods. 7. TRANSIT DAMAGE / SHORT SUPPLY: Any damage during transit must be reported to Devon Lifestyle Ltd in writing within 24 hours of receipt of goods, including the relevant invoice number(s), without which claims cannot be processed. Short supply claims should also be communicated in writing to Devon Lifestyle Ltd within seven days of delivery. No claims will be recognized beyond these periods.
8. INDEMNITY: The Customer agrees to protect and hold harmless Devon Lifestyle Ltd, its officers, and employees from and against all actions, claims, liabilities, demands, proceedings, losses (including consequential loss or damage), charges, costs, or expenses arising directly or indirectly from any negligent or intentional act or omission by the Customer or its officers, employees, or agents concerning the goods.
9. WARRANTY: Unless stipulated by law, Devon Lifestyle Ltd provides no guarantee regarding the quality or suitability of the Goods for any purpose, and any implied warranty is expressly dismissed. Devon Lifestyle Ltd is not accountable for any loss or damage to the Goods or caused by the Goods. Aside from any warranty explicitly provided by Devon Lifestyle Ltd, no other warranties, either expressed or implied by law, are given regarding the Goods. Please refer to our Warranty page for more detailed information on our warranty terms.
10. BREACH BY DEVON LIFESTYLE LTD: If Devon Lifestyle Ltd violates these Terms, the Customer’s remedy shall be limited to damages, and the total damages shall not, under any circumstances, exceed the Price of the Goods related to the specific breach, unless a lower amount is stated elsewhere in these Terms regarding such breach.
11. MAXIMUM LIABILITY: Devon Lifestyle Ltd’s liability shall not exceed the price of the faulty or defective Goods under any circumstances, regardless of any damage suffered by the Client or any other person due to any faulty or defective Goods.
12. MODIFICATIONS TO TERMS: Devon Lifestyle Ltd reserves the right to change these Terms of Trade at its sole discretion from time to time.
13. ORDER CANCELLATIONS: Customers are permitted to cancel an order within 24 hours of making it by getting in touch with our customer service team. However, this might not be feasible if the order has already been dispatched. If an order is cancelled prior to shipping, the customer will receive a full refund. If the order is cancelled after it has been dispatched, the customer will be liable for the return shipping expenses and may also incur a restocking fee. Devon Lifestyle Ltd reserves the right to cancel an order due to circumstances such as unavailability of stock or issues with payment. In such cases, customers will be promptly notified and a full refund will be issued.
CUSTOM ORDER CANCELLATIONS: The processing of orders that involve custom or made-to-order products begins immediately upon receipt of the deposit. Given the unique nature of these items, which are specifically tailored for you, they cannot be resold. Therefore, cancellations for custom orders are only allowed within 24 hours of placing the order. If a custom order is cancelled after this 24-hour period, a cancellation fee, constituting 20% of the total order price, will be imposed to cover the costs related to the initial stages of production and the procurement of materials for your order. If you need to cancel a custom order, please contact our customer service team without delay.
14. DELAYED DELIVERY & STORAGE COSTS: If the delivery of goods is delayed due to circumstances beyond our control or due to the customer’s inability to receive the goods at the agreed time, we reserve the right to charge a storage fee. The storage fee will be calculated at $10 NZD per m3 X per day and will be added to the Final invoice.

Devon lifestyle requires all such third parties to treat your Personal Information as fully confidential and to fully comply with all applicable NZ Data Protection and consumer legislation from time to time in place. We will not release your Personal Information to any company outside Devon lifestyle for mailing or marketing purposes.
You should be aware that if the police or any other regulatory or government authority investigating suspected illegal activities requests us to provide your Personal Information and/or User Information we are entitled do so.
